Looks like this campaign is loosing the steam..... My $500 have been waiting for two days now..... We started with 33% capital and not even at 50% ...this forum cannnot even run for 17%..... forget the next 50% we need to cover by 31st December.... Looks like I saved some money.

Realizeit, This is a brilliant idea that you have put forth. If what you are proposing happens, boy-o-boy!!! lot of head aches and tension would go away for folks who have applied their I-485 and waiting for a long time. Just imagine if the status changes to "ADJUDICATED-WAITING FOR VISA NUMBER" it would be as good as getting the GC.

But question is how long is long...it comes down to sheer luck and chance which pre-adjudicated cases USCIS considered recheck and which they don't.
Also they may simply deny looking into my case even if preadjudicated by the ND of I-485 receipt being outside the window.
But again why are we trying to reason.
In the "Ask a lawyer" forum...attorney Ms Reddy mentioned USCIS is sending RFEs to all cases for possible preadjudication....and since she does not mention that multiple RFEs are impossible, I assume any preadjudicated case can get an RFE so the very term preadjudication is meaning less if it needs adjudication again.
And since you are putting time frame...and window of opportunity is far and few in between so essentially preadjudication is not a confirmed ticket to Greenhood.

I was asking a question as to what should be done to people who already got their GC thru Labor Sub, since someone said that all the subs of 2007 should get the I-140 filing date as the priority date. I care only about the present and future. This is what I meant when I asked the question.

Hi, Please let me know your thought on my situation. I was on H1 thru Company A. I don't have pay stubs for the last 3 months of 2005 since i was on bench, but got the salary that is mentioned on LCA in pay stubs till end of Sept. When I asked my employer to pay me for the time on bench he said that he has paid the LCA salary and doesn't have to pay.
So having said that, am I in Status or Out of Status?
I would think that you are out of status for those 3 months, because one of clauses of the of the employer-employee relationship, governed by your employment contract, was violated (by you not being paid.)
Your employers ability not to pay, is not your fault. If/when you file for your 485, have your lawyer draft up affidavits to this effect. I am not a lawyer, consult a good lawyer for the best advice.

Dear friends, as I read all of your stories, I cannot help but relate it to mine. Even as I write this though, I am in the middle of a dilemma - I am being offered a promotion to a Director position and I cannot decide whether to accept it or not.
I have been in the US for over eight years on an H1 and have been working for a Fortune 20 firm as a Manager for the last four. My company applied for my Labor Cert back in Dec 2002 and while it cleared State in May 2003, the application was stuck in Federal processing for more than a year. Just as it seemed like they were getting to applications that had been transferred in during May 2003, the BEC took over and I literally felt like the rug had been pulled from under my feet! It's been almost two years since then, but I have seen no progress at all - zero, nada, zilch!
Meanwhile, I have been working hard at my company sorting my way through leadership changes, reorgs and changes in vision and strategy. While all of my colleagues and friends were applying to new positions and getting promoted, I lay low. Four years in the same job - I can tell you that is a looooong time! It isn't just that work starts to become a drag but also life itself seems to be in limbo and the frustration of the wait starts to spill over into personal life.
I got married two years ago and my wife, bless her heart, has been making a valiant effort to keep busy and pursue other interests, since she is on H-4. However, I know she can't wait to start working.
As all of you know, it takes a lot to succeed in the US economy and be recognized, but I have worked hard. Not only have I paid taxes for 8 years, but I also feel like I have paid my dues. I have an MBA from a top b-school and skills that are in demand. I cannot help but wonder, whether we are meant to waste our lives away?? You start feeling like a second-class human. I know I can always go back to my home country but I have invested a lot of my life here. We need justice!

This is the only link that spots to this I have seen this earlier Not sure how reliable this is ? What is the need of any sublabor demand ( per direction of this thread?) if they just retain 140 date ? There would no need in first place for any one to use it .
Here is what i found on USCIS website Posted after 7/2007.. btw this is quoted in Labor sub case.
"The petitioner must establish that its ETA 750 job offer to the beneficiary is a realistic one. A petitioner's filing of an ETA 750 labor certification application establishes a priority date for any immigrant petition later filed based on the approved ETA 750. The priority date is the date that Form ETA 750 Application for Alien Employment Certification was accepted for processing by any office within the employment service system of the Department of Labor. See 8 CFR 5 204.5(d)."

Here is something i found on the web for the interpretation of labor sub cases, the original PD stays with original beneficiary, but when the labor certification is used for another beneficiary then USCIS should allocate the new I-140 filing date as PD, not the original LC date.
Following link suggest that labor substitution should not grant PDs.

Can IV bring up this issue with USCIS contacts and see whats their interpretation of this rule?
You wont belive but the labor sub was a big mess and thanks god both USCIS and DoL realised this rule being abused and scrap it, but i am pretty sure the sub labor filed in July 2007 fiasco is clogging india EB-3 PD and it will remain at that level for next 2-3 yrs.

I was only trying to help out. I am always there with my full support. I used to be involved in student politics and I very well understand the importance of organizational strategy and planning. Keep up the great work. It's obvious that you guys are on top of things and I absolutely defer to your judgement.;)
