Can you tell exact wording you used in the letter of completion. I would assume that you need to have following statement in the letter.
"xxxxx has completed all the degree requirements"
instead of just having "would be graduating"
Do you happen to know anyone who has been granted visa with this document saying that the student has completed all the degree requirements? Also, if I get another document from my University can I add it to the file I have already submitted to immigration?

Thanks for the replies. I guess, I do not have time to get all that done before I file the I485. Damn, should have taken care of it earlier. I guess I will have to fill the forms just as I have done for the labor and then hope that I am not stuck. Will follow up with my lawyer to get some legal advice too. If I learn anything new, I will sure post.

My heartiest congratulations to IV and Core. Over the last 2 weeks I found that IV was the most reliable and quickest in giving us information.
I have a question for IV , is there a possibility of increasing annual GC quota or atleast reusing unused Visas from previous years.

there were a lot of instances when people do not even know about the visa bulletin even thought they have applied for it a long time ago. especially when they are full time employees well taken care of by their companies. for those gc is just another entity.
having said that, that should not be a reason to get into trouble in future. will it effect him in the future or not and if so how is something that he should research with an attorney and make a conscious choice for himself.
on the contrary this is just another incident by USCIS to prove how big time a**h013$ they are. seriously idiots. how come they manage to do such stupid stuff. what can IV do to counter such issues. this is a serious problem and this could jeopordize some one for a mistake from uscis. as a software engg or a mech a engg or a doctor, we as customers should be doing minimal stuff from immigration side. we have better things to take care of. not a useful post but just venting out. sorry guys.

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Retire by the time your kids become earners. Grow vegetables in back yard. Do gardening and have fun. Thats how life should be. Do not hope for green card. H A V E F U N.

Understand that everyone's situation is different, but is it really worth it to put your life on hold, that too based on the whims of USCIS?!? Just a thought. 10 years ago, the standard of living gap between India and US was so large, it made perfect sense. The gap isnt that huge any more. For some of us stuck in EB3, it could mean another 5-10 years wait. By then the gap would have closed some more. So looking back at that point in time will the sacrifices be worth it? Once again, there is no right or wrong answer, but just cant help wondering.

You are right that PD of the substute labors are clogging the lines. But something can certainly be done. We can ask CIS to assign the date of filing of I-140 as the PD for substitute case. This is not same as revoking all substituted labors. This is simply rearranging the serial numbers in the queue. And this does not require any law from the lawmakers. So this should be low hanging fruit.

Our contacts in Washington have told us that there is a growing chance of a bill to recapture as many as 90,000 visas. The language of the draft bill that we've seen calls for a full recapture of the unused visas from 2000-04.
EVERYONE should contact their Congressman and let them know just how important this is.

You're in a tricky situation. If you leave the country now you could possibly face a 3 year ban on entry. If your H1 NOA did not contain a I-94 then you're possibly on unlawful stay. You could however file for a waiver with an explanation, but it is at the consulates discretion. I would find an Immigration lawyer and consult with him/her.

So the warden can still order restraints.
The Sheriff or his officers are not Wardens. A Warden(the head of a prison) can order it if the inmate has demonstrated a history of assaultive behavior or escaped before. Neither applies. And the restraints have to be the least restrictive, not have both legs and hands shackled.
