    USCIS is much better then the earlier INS.

    International Student Advisors (ISA) attend their conferences/updates for student visas. My ISA used to say that these persons are very very rude. The purpose of these updates was to tell what they had decided to make a rule. No one was supposed to ask a question about the rule. If you ask a question they just tell you that this is how it is.

    Even the immigration lawyers are very scared of them. The lawyers don't question them.

    Hi All,

    I recently had my last name added on my Passport. I just submitted for updating the SSN. Couple of questions:

    1. Does anybody know if I need to run the payroll and also file the taxes with new name on the SSN once it's been updated. I still need to file my 2009 taxes.

    2. Do I need to inform USCIS about this or it should be OK if I just submit the new name on I-129 when I apply for renewal later this year.

    3. I maintain H1B expiring Sept 2010. I might need to travel to India before expiration with the current visa. Do I need to do anything to avoid name confusion at POE?

    Please share your experience. Appreciate your time.

    North American naming conventions are clear, it has two essential parts, First Name and Last Name. Third part, the middle name is optional, and is also insisted upon, if you have one, to be written in full on all legal docs, such as PP, SS card etc.

    Addition of something to your name probably is not adding your last name. It is rather changing your last name, legally speaking.

    Therefore, this perhaps needs to be treated as a change of name, and you might need necessary legal docs to prove that, while trying to change for your taxes or other legal docs. Merely having a new passport with something added to your name, may or may not work.

    While what you say is from a very neutral perspective as you see things from the other side of the wall, it may not be 100% true in what you think it is. These agencies or companies are a creation of the system, tons of people come from India to fill job positions and systems have been designed to accommodate that. Companies like Wipro, Infosys, etc... have HR people stamp their own H1b visa and send people in a bunch to the consulate for verification.
    Indian companies do not 'FAVOUR" Indian workers, but take advantage and try to "EXPLOIT" Indian workers to cater to businesses.
    The way the system works is, there is always available pool of talent for American businessess, these happen with rules being framed to accmomdate skilled workers.
    Just like how Jewish people good in Financial stuff, Indians have been immigrating in skilled worker category.

    While from your perspective you seem to think that it is some sort of Mafia trying to break rules and taking law in its own hands, favouring thier countrymen, it is because you don't have such a big infrastructure in China or Philippines etc... it is again the same Indian companies that are opening up branches in Singapore, Malaysia, Shangai, etc.. and reqruiting people from there too. Chinese consulting companies are now operating in full fledged manner these days and there seem to be companies that cater to Chinese Canadians looking for jobs in USA by providing them a TN visa letter and bringing them to US and place them in Client locations.


    I have nothing against the staffing agencies whatsoever. I actually like the business model. The laws are generally being followed. There is nothing wrong with it. However, I do ask many of the companies why they only have indian or south asians. Especially if they have indians coming from Germany or Singapore, etc. Common answer I get is that other people have too much restriction. Expectation would be they would have their own corporate apartment, no bench time; selection of projects and no travel. As you know this is a little difficult to accomodate for these companies.

    It generally is being clogged because it is getting around family base immigration. Although there is nothing wrong with that legally; it does hurt the people who cannot have the same accomodation. I know many, many people who have u.s. citizen brother; sponsors parents for greencards, rest of siblings come through staffing agency and then cousins get invited through h-1b and then spouse want to work and then another h-1b gets used. Eventully whole extended family base is here going through employment base when perhaps they should be going through family base. Other country people do not have such luxuries or companies looking to sponsor them specifically. Other country people generally went to school here and then went to h-1b and even then they have a difficult time getting it because they don't have the connection.

    Because of all these workarounds; it is going to cause a lot of people to be here from just certain countries. I firmly believe that lawmakers, uscis know this pretty well (i've actually seen it in an i-140 denial where brother was ceo and sponsoring his brother for greencard) and this is why they don't want to lift country caps. They understand why the visas are being dominated. Pretty tough to get them to change this, if this is the way they feel.

    Thus, as curent processing times are at August 23, 2007, dwhuser case file is yet to be opened. Since file is not yet opened, no one yet knows his/her PD (it is nowhere other than on paper files). So the case waits - his/her PD may get current and pass.

    Why so? Because USCIS prime systems are not designed for huge volumes, or PD's so much in the waiting.

    That's exactly what I thought.....huh.....the wait still goes on.....

    Coming to the Infopass....I'll have to drive 5 hrs to go to the nearest office and a loss of pay leave for a couple of days. Not sure if it's worth the hastle :)

    Can someone advice on this.
    Currently I am on H1B visa and I will apply my AOS before 17th august as dependent(Secondary applicant).
    After applying AOS if I have to leave my job then will I be out of status since I won't be on H1 status and I won't be on H4 ?
    Can I leave my job after applying AOS or I have to wait till We get receipts of 485?

    You will be in "pending adjustment" status as a dependent, but since you're not on a H4 I am not sure what may be in store. Check with a good lawyer.

    thanks for the info. both me and my wife were issued an rfe in March for which we responded early april and then again it is in a holding tank since then. hopefully we are done with the rfe nonsense and are at a place where we can be greened.

    kpchal2, your profile says that your case is approved. ND is shown to be before July 07 when you sent your I-485. Perhaps you didn't fill your profile right.

    Long time back when the british ruled India a lot of our ancestors joined their ranks and spit on fellow Indians. They were not realizing that actually the british were using them to rule effectively. That same trait has remained ever since. This is one of the greatest sin of the Indian and also many other third world cultures. They act on opportunistic thought patterns trying to gain favor whenever the opportunity arises even if it meant spitting on their own relatives. Sympathy, compasssion, honesty and integrity is often forgotten and/or purposefully suppressed for apeasement of the rulers. The feeling that you are being ruled and not in control of your own life is what really promotes such self righteous thoughts.
    If you analyze this situation you will realize that there is a debate going among american citizens regarding legalizing the 11 million folks here and those favoring are in majority now. Realize then that this is a transition phase and those who dont like this to happen are trying to do as much harm as possible. causing a girl to deliver while being tied down and asking you and me to take a driving test each time you go to extend your visa are all part of this very same process. Remember that there are many many times more americans who would support, love and care for that girl than those who care/resepct/love you.

    ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
    You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.

    What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.

    That should be our priority before any country limits or this thread action item

    Guys - Feel free to agree or disagree its just one opnion...

    I think the priority should be

    1. Get country quota out
    2. Get Pending EADs sorted per this threads idea
    3. Get ammendment to let I485 filing be done after labor been pending for say 6 months...

    My 2 cents...

    Previous employer cheated by not filing GC
    So need to change employer for filing GC
    EB-3
    I-140 approved with current employer
    Not able to file I-485 because of retrogression
    Wife not able to work
    Moving around for jobs with family
    Cheating Employer
    Frustation with H1B Extension and stamping
    Not able to Plan to go to India because of Interview dates
    Not able to plan on good school Child's education
    Not able to spend more money on good health insurance
    Lot of time and money spent on H1B Extension and stamping
    Signing short term lease for Apt's and moving around
    Drivers license based on H1B papers
    No benefits like 401K etc with small employers
    Sick with the current employer
