not all HR depts are helpful or even knowledgeable about the immigration process.

i myself was quite clueless about the immigration process when i started out and got stuck in EB3 unnecessarily. Even though my company is one of the best in the industry they had never done H1 or GC before i came along and were quite clueless about it.
This forum is meant for asking immigration questions...lets be helpful rather than speculate on the person's circumstances or acumen.

Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
however after coming here , Paid for my own ticket and landed here on start of january 2011.
I am a little doubtful...if this was illegal.
Since you had no knowledge at the time that it was illegal.
Being a foreign national you may not be expected to know every law here.
How much did you pay? was it more than what the fee was?
Did the employer processes your visa or did they use the services of an attorney?
if you...then you have a case to sue the employer for scamming you in civil court...as he may have used this trick to eat your money knowing fully well what would happen to you once you landed here.
Talk to an attorney here before you leave.

No, 45 days condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee within 45 days.

WASHINGTON � U.S. Senator Pete Domenici today introduced legislation to reform U.S. immigration laws, recommending a strategy for dealing with millions of illegal workers in the United States and improving guest worker guidelines.
Domenici today offered the Welcoming Immigrants to a Secure Homeland (WISH) Act of 2006. The comprehensive measure is the second major border/immigration bill offered by Domenici, who believes in a two-step reform approach�secure America�s borders and reform immigration issues. In November, he introduced the Border Security and Modernization Act (S.2049) to address border security issues.
�As a border state Senator and the son of immigrants, I have a unique perspective on immigration. I understand the need to provide a secure homeland for my constituents who see the problems caused by illegal entries into our country every day. I also understand the need to welcome immigrants to our country, so that America remains a country where hard-working, entrepreneurial, and intelligent immigrants can prosper,� Domenici said.
The WISH Act would authorize a series of reforms to U.S. immigration laws including:
� Improving immigration law enforcement
� Creating a new guest worker visa
� Establishing a process for illegal immigrants in the U.S. to gain legal guest worker status
� Improving foreign student, highly-skilled worker and visitor regulations
�The time is right to fix our immigration laws, which are not working properly,� Domenici said. �My bill strikes a sensible and realistic balance between cracking down on illegal immigration while encouraging legal immigration. Slamming the door on immigration or unilaterally deporting millions of illegals already in the country is just unrealistic.�
Domenici said he will encourage the Senate Judiciary Committee to carefully consider his WISH Act and S.2049 as it readies comprehensive border security and immigration legislation for consideration in early March.
Domenici�s bill would increase the number of Department of Homeland Security personnel to investigate human smuggling, employment of illegal immigrants, and immigration fraud. The bill would also increases penalties for violations, as well as provides a system for verifying worker employment eligibility.
The bill would create a guest worker visa for up to three 3-year periods (9 years total) for immigrants to gain legal entry into the Unites States, and potentially apply for permanent resident status. The bill would allow 500,000 such visas the first year, with subsequent visas increased based on market need.
The measure establishes a program to allow illegal immigrants now in the United States�estimated at up to 12 million people�to apply for legal guest worker status. This proposal entails paying a fine and obtaining a legal guest worker visa.
The bill would clarify the limitations and restrictions placed on student visas after 9/11 in order to allow high-tech foreign workers and full-time foreign college students to study, work and travel in the United States. It would also establish a means for foreign students who graduate with honors to be allowed to work in the United States.
The following is a summary of the major provisions of the WISH Act:

If an illegal alien fails to apply for the visa and remains in the United States illegally, he would be removed and not allowed to apply for any immigration benefit except asylum. After being in the United States 5 years under this visa, any alien who had been in the United States for 5 years prior to the date of enactment of the WISH Act would be eligible to apply for a different visa (but not permanent resident status), but such a visa would not be issued until the alien left the country and reentered thru legal channels. If no new visa is acquired for such aliens, and for all undocumented aliens who have been in the United States less that 5 years before enactment of the WISH Act, when the initial visa expires (after up to 9 years, assuming the alien renews the visa and remains employed), the alien would be required to leave the United States for at least 3 years. Contrary to what most believe - Contributing is the easiest thing to do. Send some money and forget about it. And the most effective one too. Lobbying is IVs greatest tool to make changes in the legal system. If you still don't get it, you cannot get any law passed in Washington without lobbying. Whatever we do on the side is to help that effort.
Volunteering is much more tougher. By volunteering I don't mean giving the next Brightest Unworkable idea or the daily-dose of rants on an online forum. Volunteering in my world (real one) means sacrificing personal time (with family) for the greater good of a community.
Calling members, planning & conducting meetings, telecons, write letters to lawmakers and meet them, put IV booths in local events. In short, it's a thankless job. At the end of the day you're more hated than loved (ask Chandu)!
IMO Volunteering and contribution are not separate. It's member buy-in. Either you agree to a principle or you don't. If you agree, you'll contribute as well as volunteer (when you can). If you don't agree, you don't.

I would strongly suggest everyone to acquaint himself/herself with the legislative process and how a bill moves through different phases / steps before it becomes a law. You can find many postings documenting the process.
Right now it is just introduced in the senate. The problem for us is that Sen Durbin is Democratic Whip (i.e. Assistant Majority Leader) which gives him tremendous influence over garnering votes and referring which legislation to consider to the Majority Leader (Harry Reid in the Senate). Ultimately Reid decides which legislation get priority consideration. The fact that Grassley is a Republican and is close to the Minority Leader (I think) does not help us either. We will monitor the progress of the bill.

How many core IV members have already received their GCs besides Aman, just curious?
Of late is there anything of note even happening on the lobbying front? IV seems to have become another Immigration Portal kinda website where people are now posting all sorts of info, some of it not even immigration related.
It would be nice if someone in the core team updated the rest of us, who cannot join the state chapters due to personal reasons on the website.

You 3 years Bachelor might be an issue... also your Bachelor and Master's are not in the same field. So I am really doubtful you will get through EB2. Now a days USCIS is very strict about the degree..

Folks don't get me wrong, i understand what you guys are going through. my family and close friends are in same limbo. and if any of you has spouse on H4 you will surely know the wonderful status it is to be in. All i am saying is, if there is too much demand for something, there will be a price attached to it. A British can get US gc faster then a Indian cause there are not that many british who wanna come here. and Since USCIS knows we are almost on our knees, they treat us like dirt. Once the demand goes down and more and more Indians will start to look else where, they will start treating us with respect too. Case in pint china, track its history with USCIS, Chinese no longer flock to US, in fact its US who now depends on Chinese money and all and treats its citizens with respect.

There is nothing to enforce. If there is any, they would have enforced long back. It is too broad. But increasing fees won't make any sense. They have to correct the law, not imposing higher fees to everyone.
1.Audit the companies that are suspected to abuse the H1B program i.e. enforce the laws that are already in existence.
2.Impose heavy fines on these companies.
3.Use this money to cover the costs of auditing and enforcing the laws.

Your lawyer is probably correct. This has to do with IO who are not aware of AC21 laws. But make sure your employer did not have any issues with DOL, USCIS in responding to RFEs related to other employees like H1 RFE, ability to pay , etc which may be used against your application.
