Doesnt consulting clause remove most of the Indian companies from the picture anyways?
May be US corporations can tactically support this bill because this bill will impact Indian bodyshoppers severly. For past 5 years US companies could not compete with Indian companies as they have more leverage on H1b. Now if Indian companies avoid H1b US companies can get any time they want as they can satisfy most of conditions

For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.
This is my 140 status from start, people say that Department of state is not normal. i opened a SR on 10/15/2009 and the status of my case is

I have a valid H1 approval till 2011 and used AP for my previous india visit. Right now i am transfering my H1 to a new company.
I asked my lawyer if i was on H1 status or not? She replied, Unitl you use EAD, i will be on H1B Status.
and also we can transfer our H1 to new company also. thats what i am doing now.

Duration for I-94 while entering on AP is same as validity for AP. I am not sure what will happen in the scenario below:
A person on H1B validity for two years enters US on AP, which was valid for an year. He/She gets I-94 for only one year. in case person do not have any travel plan for next two year, will he be out of status after year as I-94 would have expird after one year and he/she kept working for H1B sponserer for two years.
Another questuon is Does renewed AP also comes with new I-94, like H1B renewals?

I am little bit worried because IO needs to go to HO and get approval before they can approve an applications due to pending name check over 180 days. there was law suite and Judge has forced USCIS issue green card if name check has been pending over 180 days but, there has been new memo from USCIS field director and IO has to write to HO and get approval in these cases.. I am not sure whether an IO will be willing to go head office for an applicant.

When I was asked to resubmit documents after the interview (via drop box), the consulate said they will need 6-8 working days from the date of receipt of the latter. They indeed took only 7 working days.
Also, I believe they must already have done PIMS verification in my case since they asked for additional info 16 days after the interview. So in total it took them 29 days ( incl weekends)
In your case, it doesnt seem they got enough time to do PIMS. It is hard to
estimate the delays.
Good luck though buddy....you will be fine.

February 1st (friday afternoon)- status updated to 'send passport' on chennai consulate website.
My concerns are -

Please help if you can. I have already rescheduled my tickets twice...

I agree with this, we should definitely do this.
Since IV has contact e-mails for all its members, it can also send periodic e-mails on its activities, funding drives, recent achievements and ask for the members to contibute. This will be helpful for those who dont visit the site very often. For Example, recent update given by pappu inspired me to sign up for monthly contribution. But that would happen only if i visited the site very often. I would have missed it if i am not a regular visitor to the site.

K , I see two views by two different types of folks.
View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.
View #2: Some people come resigned with the idea that they will be looked down. Now My question is what do you want to accomplish on IV if you do not want to work on the issue, If you do not want believe in the core principles of this organization. If you think that immigrants are treated like dirt and again if you believe in that and because you are an immigrant in this country, you should have been putting up with a treatment like dirt, do you have an iota of self esteem?? Seriously, If you really believe what you are saying why do you even want to be here now? or why do you even want to have a backup plan that will again make you a immigrant some where else?? $$$ over ride self esteem Huh? In the name of discussion you want to shape the opinion of people who do not talk much. Kudos to your agenda. You keep spitting out your rhetoric that immigrants are dirt but cannot make arguments that hold water for a single second.
I compared the president to show that immigrants and sons of immigrants can have a life that is quite opposite of what the OP said. It comes down to the difference that you dont want to work on this issue and have things served on a silver platter, while many of us want to work and fix this issue. Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. Coupled with the lack of GC, his risk might be more than some one else.

The only problem may be in finding a school district willing to file H1 WELL in advance and accepting the fact that she cannot start working on SEP 1st (when the new school year starts) but OCT 1st.

I assume you've likely never studied in India though. An bachelor's degree in engineering is not very expensive, if you have good grades.
10 years back it would cost about $100-200 a year, if you qualified through a state ranking system.
Tony, I didn't grow up in India. I am oblivious to its education ways. That said, some of the comments expressed here, is not the way to talk to anyone with an education, no matter what school they graduated. Anyway, I'm done here.
