Lets move on and focus on this main topic...

Here are my observations.. Correct me if I am wrong..

1. L1 option for IT is essentially killed

2. Small IT companies will limit the headcount to 50 per company. It doesn't cost much to have more than one company. So no major changes to H1B Desi companies.

3. Most of the big American companies will not offer new H1B with 180 days, since most of them would have had layoffs.

4. Most IT companies will start spending a lot on lawyers. So they will be rich. There will be lot of audits.

5. Companies will complete PERM and I140 before getting a guy onsite, only if people are really interested in coming to USA any longer.

6. Need more clarity on where H1B outsourcing will be stopped...

Good recap. This bill is not about liberating employees. This bill is to kill H1Bs and L1s irrespective of whether the company is a consulting company or a direct employer.

Net result ? more outsourcing. Big outsourcing firms have enough experienced employees on their payroll to do outsourcing effectively.

If this bill passes, it will be a shameful day for USA.

I am afraid you are being naive here. What the OP is saying is

(1) We should all go back to our home land, because he has some opinions and positions on what is considered turning back to home land. You might not see it but he is trying to shape opinion of others very intelligently. Who says this? Some one who does not want competition here. Well, if this was coming from some one who is in India I will give him props. He is in US for 10 years and he is saying US GC system sucks and I will go to canada in 2 years. Damn it! I am better than him because I will go to India and not canada. I will stop short of saying that every one should go back to India or his/her homeland.

(2) We all have no right to talk because this is not our country. or We are not in our country and we should not talk. Who says this? Again folks who dont want people here.

(3) Even if I give him the benefit of doubt on other issues, he thinks country caps are OK. Any one who argues for country caps in EB GC with out asking for a country caps in F1/H1B which server as conduit to H1B actually wants the disadvantage to lot of people to his advantage.

Just dont read the words as it is. try to infer some thing. These days trolls have got too much brains.

I believe we have rights. If the million of illegals think that they have the right to stay, why can't we? Obviously, everyone has their own experiences in the US. Some of you might not have hit the "boiling point" yet and so you might not have felt the heat!!! There are people who carry the entire family here and they depend on the GC to make a difference in life. You are you and you are entitled to your own interpretation as to whether or not this is RIGHT or Privilege. I believe what LogicLife said is very true as Immigration is a movement in life. If you don't believe, you probably don't deserve it when someone said you don't. I've been here for 12 whole years, got married and bought a house. I have been paying colleage tuition, taxes and my duties as an entity in this society. I deserve a green card.

Folks,

I know many of you may have already thought about this at some point. I'll lay out my views on the donations...IV can object/correct.

I'm following the donations thread along with many of you and there is not much to be excited there.2000$ in 2 weeks....for all the Agenda that pappu has posted. I understand that everyone(including me)...will have limited resources at our disposal every month...may it be mortgage/daycare/medical/school or those unexpected repairs...so the bottom line is there is not much room to increase our monthly contributions or...holiday contributions.

I was thinking...we are 25000 'real' people...and there are more than one visit by each person to this site.

1. Can IV use any space to advertise...so that IV can get some AD Money?

2. Is it possible to get some space on popular pro-immigrant or immigrant driven websites...to donate to our cause?

3. Would it be possible to split the donation denominations further down...like 5 dollars..or even low..so that all immigrants...including people who got the GC's/Citizenship can contribute with out looking deeper into their pockets.

4. Optional....ebay/paypal donation to the peoples questions/answers...Mind you it is totally optional...if you want to donate 5/10/20/100...or how important the question is and hw satisfied the person is with the information...etc

5. DOnation boxes at Immigrant owned grocery stores...with out compromising their principles

Folks, I have layed them out with good intentions...and have also given a thought of what I personally can do for each point above...I'm not expecting the vultures to prey...on the post with mundane comments.

I have taken my Ex - employer to DOL and USCIS and I was successful getting my money back.

If you go with lawsuit then it becomes partially a Civil case rather than criminal offense.

This is a good option-to sue your employer but if you want a free attorney then let DOL W&H division do that job for you. Their officers will audit the employer and will check their records for the last 5 years and will also fine them.

Couple of points I disagree,

1. If we assume them as I485 apps, we also need to take Family numbers into account. So EB2 LCs can only be around 23000.
2. In 2007, Perm wasn't as hopeless as it is now. So people were getting LCs in less than 3 months.

So adding all these, here is my break up

This is even if you tell them they will be stuck with the same employer and job profile for years, and no hope of a GC for the next 7 years. The lure of the US is still big. If the Repubblican Senators will confirm its vote, the Filibuster will be impossible.
We will have 9 new senators, 7 dem, one Ind, and one repubblican.
Except the senator from Montana, all the news dems are favorable for the CIR., as well as the Indipent one. I don`t know about the new senator from Tennesse.
Also Kyl was talking about the original plan from Mc Cain (who will be a runner, which means that he needs the latino vote)-Kennedy, the one passed from the senate was little bit different. Let`s hope for the duck in anycase....

If they keep the ON HOLD status for more than 45 days... That event is again a potential lawsuit material.... Because they are changing a Long standing practice which requires lawmaking ( ref: Rajiv Khanna's quote)

Regd AILA lawsuit i believe they are deliberately delaying so that USCIS change the Bulletin to C on its own ( from the fear of lawsuit). On the other hand USCIS is not doing that because they knows this weakness of AILA and trying to keep things stretching so that when OCT arrives this whole move will get weakened .... As soon as new bulletin with some availability comes out peoples will start losing motivation ...

I strongly believe that AILA and USCIS are cousins with the same last name. I smell something fishy when AILA files a lawsuit against its cousin.

A lot of people, including me have lost faith in IV. They are not going to pay. We don't know what IV is working on


I believe the core group has made efforts to let us know what they are working on. Obviously, we shouldn't expect them to give us a daily update. That would be quite stupid.


and we don't believe it can do anything. The sooner IV accepts it, the better. I have seen this personally in talking to people and you can see the evidence with less than 300 people contributing. IV needs to produce results first.


I think this has also been addressed here in different threads. IV cannot, just by itself, get congress to pass pro-immigration laws. However, it can influence the senate/congress to add pro-EB provisions to pro-immigration laws.

If you think that with 8000 members, and 300 contributing members, you can have the congress/senate pass pro-EB laws, you are grossly mistaken.


IV needs to figure out other ways to generate cash if it thinks that would help. One way would be advertising on the site. I think IV has built this website well and it is an asset it needs to use NOW. I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

Great idea.
Except, nobody is going to pay 10K/day to advertise on this site.
For a group that can't generate more than 4k-5k per month (200 contributions times 20) for something that it desperately needs, it would be an absolute travesty of common-sense for a business, to invest 300K per month in advertising to such a group.

Keep in mind the following two equations.
Membership+funding+lobbying+patience = Chance of success
Sitting on our butts = Guaranteed failure

BTW, I would also like to point out the antiwar website again.
They are doing a funding drive.

On day 1 of their funding drive, 117 people gave a total of 5312 dollars.
Their goal is 70K for this quarter. And they hope to raise that money in one week. After this week, they will again ask for funding in the next quarter.
Obviously they have a HUGE membership compared to IV. But that just underscores the need for increasing membership.
