    I think Senior Member's should come up with some kind of a solution to this situation.

    A member becomes a Senior Member with his/her 100th post. My dog can post 100 messages and become a Senior Member. Here (http://immigrationvoice.org/forum/showthread.php?t=3396&page=14) is a sample of posts that count towards Senior Membership. I will not be surprised if a large number of Senior Members have made no contributions.

    On the other hand, there are members with very few posts, who have made significant contributions to our cause and act very very rationally.

    In short, Senior Member means nearly nothing. Just ignore. Check their posts.

    Please be considerate towards members spending time to fix issues that affect you and your family. At the time when english_august posted, these was some problem in the application. I know this because the message I posted just before english_august was also repeated 2-3 times. Kindly give others benefit of the doubt before cherry picking their faults.

    You are already enjoying the benefit of filing 485/EAD/AP in July-07. Atleast be considerate towards people who contributed their time, energy and resources to - in lot of ways influence the outcome of July visa bulletin.

    And if you or H1bslave et al don't see any value in IV, then why do you visit this website and why do expect updates?

    Was the H1B through a body shopper? I"ve heard of reopening all old cases of a company if they find a dubious H1B sponsorship, or if a company gets blacklisted.

    If your company is solid and your case is genuine... you probably have nothing to worry about.

    Your points from 1 to 5 point the same thing. They drive down the salary of H1-B and other citizens. They have many undue advantage and its high time L1 be capped and restrictions be placed.

    First thing, I'm not trying to divide L1 and H1 here. IV is for H1-B and GC processing and some L1 (genuine L1) and not for L1 in its current form.Whats going on in L1 is blatant abuses.

    I dont have problems with genuine L1s who wants to settle down and apply GC. But 90% of L1s, just come for 1-2 years, take away jobs to India, drive down wages and never interested in settling down


    The wireless company I work for, used to be a huge employer for H1s (primarily contractors). Now thanks to TCS and its army of $1 an hour L1s, slowly they are terminating contracts and giving it to L1s and shifting jobs to India

    High time, they stop L1s. Wake up and see around

    He is undoubtedly a populist (he used to be a sycophant earlier ... remember the earlier days on CNN ?), the man is cheap no doubt. He is a nativist, who claims immunity to such charges laid upon him. He never mentions that he is married to a hispanic american lady - well that is a deliberate attempt at cover.
    Guess what the " hard core republican ", corporate CEO loving, capitalist champion is now the warrior for the middle class and a critic of the current administration.
    Can you actually believe this guy?

    I dislike his show, i do not rescept his perspective (because it is mostly based on incorrect or false information) and i sincerely believe that he is a worthless parrot.

    Time to act - we must begin countering him.

    ok, I did not take private coaching (not that its relevant to a 3/4 year degree) and we had quite a few lower-middle class students in engineering.
    As for poor families - A MCA at IGNOU costs a little over $1000. I'm sure its similar in other distant learning courses too.

    that may be the case...but maybe the guy couldn't afford the 4 year engg...did the way way cheaper 3 yr bachelors...then worked ...made some dough...decided to study further to advance...so did MCA ( repeating a 4 yr bachelors is not sensible or economical at this point)

    This is all speculation ofcourse...the point is we don't fully know the person's circumstances and should not judge based on face value of the degree...if the person is talented he/she will be retained by companies who want to keep them.

    Need only one year tax return"

    I got RFE today asking company's 2001 return
    basically ability to payproffered wage that year
    wage were $53000 per year.
    Join the company actually in 2002

    There was a company change change with same dba xyz ... in year 2001,(means employer close the company and open another one with different name at same location)
    Same Owner and same business location so company file two taxes for company 1 and company 2

    Company 1 2001 tax return shows net income of $25,500
    Company 2 2001 tax returnshows net income of $28,300

    company bank account also shows over 100k in 2001


    I call my attorney already and did not hear back from him yet on this issue

    Can my attorney submit both tax return and claim one is the succsseror company(means employer took all acids, inventory and liability of old company of all the company) and presented to RFE office and
    is it very complecated case or simple case ?
    please help.
    I need your folks input

    Based on this poll, anybody with PD of Jun2002 onwards should consider Porting to EB2.

    Any thoughts?
    It won't help, if everyone starts porting, EB-2 queue will face a similar situation. Porting doesn't happen soon either. With delays in I-140 processing, it may be close to 2 years before you could file for a fresh I-485 with a request to port the EB-3 priority date. Note, this is a grey area and doesn't guarantee you the old PD. If the company is willing to foot the bill, go for it or else IMO it is not worth spending your own money.

    Legislative or Administrative fix is our best option. We should focus on the recapture bill and other initiatives by IV, contribute and participate in the action items. We, as a community should raise enough money for lobbying etc.,

    My understanding of SKILL for US MS is that it will not be counted against the cap. I don't see it saying that PD does not matter for US MS. What am I missing? Thanks.
    if you are not counted against cap, that is equivalent to visa available = PD current.

    Sent in my contribution, even though i havent started my green card process yet .. and may never get around to starting it if the GC status quo continues. However, this is a just and commendable cause, and I believe we should do all we can to get favorable reforms passed now .. strike when the immigration iron is hot.

    Sen. Charles Grassley (R., Iowa) apparently didn't read your "The Grassley Visa Tax "editorial of Nov. 2 ("Investing in America, Making Things Worse," letters to the editor, Nov. 8). His first two paragraphs made statements that were blatantly false. Spoken like a true politician.

    No successful business hires an H-1B visa holder just to fire an American worker. Because of the shortage of trained and competent workers, high tech workers are paid the prevailing wage rates. Sen. Grassley is overlooking the term of the H-1B visas. No business wants to train a worker who will leave in a short time. Successful businesses are built on the expertise of long term experienced workers. H-1B workers are attractive because there are not skilled Americans available.

    Sen. Grassley should consider the interests of the country as a whole instead of pandering to special interests and he should consider legislation to improve the performance of Americans instead of making false accusations to polish his image.

    I never have and never will like the idea of being asked to pay, I give what I can unasked. What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.

    Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?

    I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose.

    *sigh* I might have just opened myself up to the ones that like to attack....go ahead...

    your title is misleading. where is the "plight" that you refer to?
    Also, EB2 applies to jobs that require a Masters degree as well, not just PhD.

    An MS can be completed in as little as 9 months (YES, 9 months, if you apply for MS in a school that follows quarter system and complete coursework but no thesis) for majors like Electrical and Computer Engineering. So what is the plight for folks who completed MS in say 9 months to 2 yrs, and how is it different from the plight of EB3 folks?


    Yes, that is right, I said �plight of EB2-India�.

    I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

    Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

    Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

    There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

    All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

    For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

    As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.

    From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

    Flowers to Condi; any body?
