I'm July 2007 filer and per the Aug visa bulletin my I-485 application is current (PD - Feb, 2006). I raised a SR with NSC on 15-Jul to find out the status of my application and here is the response I got from them today:
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below.
I'm kind of worried as I haven't seen folks getting this response. I haven't gotten even a DMV ticket and not sure why would I get that kind of response. Please advise what should be my next course of action and if there is anything I can do from my end.

I just looked at my old cases(H1Bs-I-129) and i see LUDs on them too!!! This is so weird.
These are from my last company!
LUD on 05/06/2006 - Approved on October 11, 2003
LUD on 10/21/2007 - Approved on March 19, 2002
I see LUDs but no difference in the status. They both say approval notice sent.
whats your PD and 485-RD? Maybe your case is close to approval and they are just looking up older H1s

Ok. I agree with everything you say but you still haven't explained why EB-2 China hasn't moved. They never were Unavailable, which means they haven't used their quota but are still retrogressed. Why absolutely no relief for them? Not even a month forward movement?
To be honest, I have no way to know why absolutely no change for China. There have been times earlier where India and China had similar cut out dates, then they changed dramatically, then India became unavailable, and now they are same again. With so much happening, I would say its very difficuilt to have a logical reason with no real data.
All I can come up is that perhaps China might had a little higher demand than India in the last few months, or just that in case of spill overs, most visas might be consumed by countries most retrogressed, or perhaps DHS believes that the number of visas spill over would be only enough to cover EB2 Inida + EB2 china up to a certain date and China was already at that date, so if the demand is less than expected, then we will see movement in both India and China.
Wish best for all Employment based filers. Hopefully some law change comes and justice is done to every one.
I would hate to see different immigrant groups worrying about which group is getting ahead.
Keep contributing to IV effort and hope no one need to go through extended wait times..........

IV has to priorotize before going to a lobbyist, with very very few contributions made, its very difficult to have everything bundled into a single request.
Its also unfair that L1 has to work for specific company but L1 spouces can work for any company any job, its so funny, when you think H1 has to work for specfic company and only for specfic job, but spouces can work for any compnay any job any salary without any labor department intervention
Immmigration awareness has increased a lot among US voters, when it comes to threat of their jobs being lost, and democratic senators are very much aware of it, hence CIR is no longer their priority.
I am not fighting but YES, my reason to join IV was to find justice to the H-4 not being able to work when L-1 spouses and Agjob spouses (I read this a year ago) could. Although no promises were made from IV, I was surpired today since nothing was ever said regarding no interest in the H-4 cause when many discussion were in place. Here people contribute for their own benefits, I was here for the H-4s, that is why I transcribed part of the conference calls too, so I was somehow a contributer to a cause that doesn't represnt my interests, but I know it represents the interests of the unmarried folks, or married to IT spouses folks.

I dont work for consultant and yet I relocated last year. I admit its less frequent when you work directly for a company. I work longer hours not because I am told to, but it makes me feel more secure in my job by doing so and by making myself more useful than neccesary. I dont mean to say that marrying a local is wrong, but it is illegal if you are doing it only for immigration benefits resulting from marrying a citizen and you could lose that greencard if things go haywire. To quote Shushterman, an immigration lawyer and former USCIS employee: If you are caught doing something illegal by USCIS, you are better off robbing a liquor store than marrying a local with intention of greencard. USCIS may pardon you if you robbed a liquor store, and still give your greencard but not if you married a citizen with intention of immigration benefits.
Now, coming to rights and privileges, privileges wouldnt exist unless you had the rights. Privileges granted by Government to public are based on rights. There are some things that the seeker calls rights and the person who grants them calls them privileges. If you want to be forceful, you have to call it a right, not a privileges. We call "Human rights" rights for a reason and not "Human privileges". See, privileges imply a hand-out. Rights imply justice. There is a difference between hand-out and justice.

I had a quick question to ask. My, current H-1 visa is expiring on July 30, 2008. Also, my current I-94 and I-797 is expirin on the same date. I am eleigible to apply for extension 6 months in advance, starting Jan. 30, 2008. However, my question is if I apply for my H-1 visa extension now (say Feb. 28, 2008) and the extension comes by April 30, 2008; will that invalidate my H-1 visa stamped till July 30, 2008.
Please refer me to any official memos if available. Thanks in advance.

I am now waiting for October 1st, attorney said that they will send an inquiry through AILA. I am not sure if I should call USCIS now, as they tell me to call after 60 days based on the response they sent to the inquiry that was made by the local senator.
I also got a response for my 09/04 Infopass appointment today. It says "Based on the documentation you have provided, your cases qualifies for expedited processing. You should hear back from us within 45-60 days. If you do not hear back from us within 60 days, please call us back.
I have no clue what that means? I have not provided them any documentation in the last 2 years. LUD on my case is from April 2009 (when I filed for AP/EAD) and status update is for the document they sent to me for FP in September 2007.
I filed for AP last year in May 2008 and didnt see any updates at that time either. I have no idea where my case is or whats going on with it. Let's hope for the best.

I agree that recapturing lost no's from previous years will be the best possible solution.But to do that we need intervention from the congress and the President needs to sign a bill to recapture the lost no's.To accomplish this goal we need to keep up the momentum generated from this june bulletin fiasco and intensify our lobbying efforts in Washington.
Kudo's to the IV core for their strong campaign in championing our cause.
