I recently went to South Korea and entered the US on the AP since I didn't feel that I had enough time to wait for my H-1B stamped in my passport at the US emabassy in Seoul. Before leaving the US, I consulted with my attorney on this issue and she assured me that my H-1B is valid as long as I file the extension and maintain terms of the H-1B visa.
Per your attorney, you need to file an extension. How soon does one have to file? Do you have to file one even if the current one is still valid for more than 6-month? Have you done so since your travel? Thanks in advance.

You can't do anything to ICICI - they are private banks and the way they have agreements when you send money - they can tweak dates when to actually dump the cash , change exchange rates anytime ( within a reasonable range) to increase their Profit margins. Its just a smart way of doing business and making - i wont call that 'stealing money'
If you want to be smarter than them jump to online SBI boat , they have the best Online rate and let ICICI know next time that you switched loyalty because they were getting smarted beyond range.
www.onlinesbi.com/glsus/
I used to transfer money earlier by Remit2India (R2i) and sometimes C2i but since then they started making ( or your stealing) more brokerage money out of my hard earned dollars - i switched
Let me know how you feel the online SBI - they are always 15-10 p more than ICICI or CITI so at the end of year if you save average $25k you are anyway saving Rs 2.5-3k. Not a big thing but they maintain some ethics about tweaking rates and the exact day they dump the cash to your account - i got about 43.25 when market rate was 43.57 and those smart banks ( or thieves) were doing around 43.07..43.12
Hope this helps.
I have sent money using icicibank's M2I service . Usually they take 5 working days to remit the money(atleast 8 days to transfer). I made four transactions last week(mon, tue, wed, thu) and they already remitted the money using low conversion rate.
It just took less than three days to remit the money this time. Bank deliberately did this just to steal money from me. I have lost more than 35 paise per dollar and it comes close to Rs 10,000. This is ridiculous and its a big robbery.
How do i get my money back? How do i make a compliant about this bank? They have no one to assist me over the phone.
What to do now?. Rs 10,000 may look too small for us. But how can we let banks to act like a criminals.
Any help/suggestion/comment?

There is no dearth of MORONs here. Here's another one. First Moron snathan asked me for website one may ask why? just because my handle was similar to somebody's.. Now this Moron RollingStone12 thinks i am PlainSpeak for reasons only moron can come up with and is asking for address. I doubt if he will be willing to 125 St Harlem.. but you never know he might just because he is a complete MORON... so I am scared to give out my address :p
YOU two will make a greate MORON DUO
Again you win....I dont have the capability to fight with a Slut...now go back to your hole, take a pill and sleep and come back as PlainSpeak.

See how Numbers USA propaganda
They are saying these bills grant Amnesty.
I pity them.

Please contact your U.S. Representative through the Capitol Switchboard (202-224-3121) and ask him/her to do everything possible to stop the passage of three bills in the House Judiciary Committee today: H.R. 5882, a bill that would add an additional 550,000 permanent green cards; H.R. 5924, which would add 20,000 additional foreign nurses per year for three years (plus their families); and H.R. 6020, which would grant amnesty to the illegal-alien spouses, children, brothers, sisters and parents of all 23 million U.S. military veterans
Can we sue this guy from NumbersUSA for misguiding American public and creating hatred against immigrants ?

What I've said is: IF you think....
If you don't think that way, this doesn't apply. :)
So please stop taking it personally and stop getting all worked up about it... :)

I do not appreciate you pretending to know what I think of everyone in here and their work. (Which just for the record I appreciate very much!)
Simply put: I did not and do not think of anyone in here as an idiot.
So please refrain from saying that in future.

I have some personal experience in this thing. In my case it was 750K, nevertheless a large some.
Question for you: Were there any injuries in the accident?
Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..
Thx,
PD is Nov 2006.

nope, if the alternative to the GC system is outsourcing (as you yourself mentioned) all the profits go to big corporations and our salaries are spent in India. The corporations are notorious for avoiding taxes so teh government gets nothing. By making us stay here longer (on H1 or GC) we end up spending our salaries here, paying taxes, paying social security, paying medicare.
65K H1-Bs earning 70k a year is 4.5 billion dollars. 140K new GC holders each year earning the same comes out to 10 billion dollars. Out of that taxes alone are an easy couple of billion or more dollars. Then take into account the side-effect (we buy cars, we buy appliances, we rent apartments) and the contributions we make to this economy are a lot.
And to say that we are stealing jobs is also inaccurate. There is nothing called stealing-a-job. In general every job is worth how much someone is willing to be paid to do it. If an American citizen wants 100K and the GC holder wants 90K and the H1-B visa guy wants 80K (and all of them are going to work in the same city and same office) the job is worth 80K. The H1-B visa holder is not stealing a job. The days of knowing HTML tags and commanding a salary of 100K a year (1999-2000) are long gone and now replaced by 'that kind of work gets done in India or Ukraine for 10k a year'. Looking at the resumes we got in response to job ads placed in the last 3 companies I worked for, there are simply not enough qualified americans interested. Thats a fact. So the IT sector needs help from abroad to get the job done. They can either send the work over, or bring the people here. Bringing the people here also benefits the rest of the economy.
I did not say outsourcing is the only alternative. I said they will have their own people take these jobs or if not, they will ship out these jobs. Do we really believe there aren't enough Americans to handle IT work in America?
H-1b is not cheap labor. American companies prefer to hire H-1bs with US master's degrees or with substantial amounts of US experience. When they do hire foreigners, they do not discriminate against them by paying them lesser.
H-1bs are abused by desi vendors and the like who take advantage of the indenturing nature of the visa and also on the naivety of "fresh off the boat" people who newly arrive into the US and are unfamilar with US economy. They are starry eyed, still busy converting each dollar into their local currency and feeling happy they are earning relatively more and dreaming about paying off their EMIs back home, sooner. It takes quite a few months for them to settle down and understand US dynamics.
Lastly, we should not confuse the need for H-1bs as equal to the need for GC holders. Take the example of middle eastern countries. They use foreign labor, but they never grant them permanent status. That way, they do not get stuck with them in the event of a downturn. American could have chosen to follow a similar model. Use H-1b temps when necessary and send them out when they are expendable. They have no reaons to hand out GCs, like I said earlier. The benefit is all ours.

Thanks kubmilegaGC!
I will call the senators immigration liaison tomorrow. Hopefully she will not tell me that they cannot do anything besides what they have done because that is what they told me in September last year when I got a standard response last year.
Unfortunately nobody understands the pain and agony we are going through. For them, its just another day at the office, they couldnt care less. Nevertheless, I am going to try tomorrow.....hey, cant give up that easy.
I will call CS again tomorrow, I dont mind being yelled at and I am gonna tell her this time that I have not opened a SR. Atleast, she will then transfer my call to a IO.
Let's see what tomorrow has in store for me!!
Thanks @natraj @fatjoe @Vikki @apb - thanks for all suggestions -:)
@ cali - talk to senators's immigration liaison and explain the contradicting response(s) that you are receiving and ask if they could help - at this time lets take a diff approach - let them ping USCIS rather that you..see if that works.
@fat - 2nd SR was for wife and we seriously think that IT did the trick
I am wishing THE BEST for all of you who are waiting...next few days guys - you will get it! 100%

My PERM got approved on 07/23/2007 and my attorney is planning to file I-140 and I-485 concurrently by Aug 15, 2007.
I was offered a wage less than the proffered wage till pay period 07/15/2007 and my employer revised my wage to match the proffered wage from pay period 07/31/2007. Hence I would be able to submit 2 paystubs for payperiods 07/31/2007 and 08/15/2007 with I-140 application, which shows that I am currently getting paid the proffered wage.
Please let me know if these 2 paystubs alone are sufficient to demonstrate ability to pay.
We wouldn't be able to submit the employers Quarterly Wage reports with the revised wage as the current quarter ends only on Sep 07.
I understand that USCIS will issue a direct denial without an RFE if the employer is unable to prove atleast one of the following
(1) Net income - The initial evidence reflects that the petitioners net income is equal to or greater than the proffered wage
- (Supporting Evidence : Tax Returns).
(2) Net current assets - The initial evidence reflects that the petitioners net current assets are equal to or greater than the proffered wage.
- (Supporting Evidence : Audited Financial statement)
(3) Employment of the beneficiary - The record contains credible verifiable evidence that the petitioner not only is employing the beneficiary but also has paid or currently is paying the proffered wage.
- (Supporting Evidence : Annual/Quarterly Wage reports, paystubs)
Ours is a small company and doesn't have net income or net assets matching the proffered wage.
Can anyone please answer this question?

This is good news..But the Damage is already been done..in the past.....
I guess DOL had some 300K cases pending when Backlog center started..It adjudicated some 150K till now.( Rough Estimate) and still 150 K left.
Even if considering 10000 Labors been substituted till now ...Imagine the wait period for rest of us. I wish this law was enacted, when they started Backlog centers..
Anyway..something is better than nothing....Hope for the Best...for new laws regarding SKIL,CIR Etc..atleast filing 485 when Visa numbers are not available..

This bill is only for FB. IV has to give some direction on this bill so that we can push to include EB too in the bill.

I sent that question in for the debate about 2 weeks ago. Glad it is on the list. I cannot access this link now for some reason
I guess we should use chances like these to get our agenda heard by the people and the govt. There are going to be atleast 3 more presidential debates we should try to get this question asked atleast in a couple of them. We can modify the question to make it more broad, but still keep the focus on legal immigration problems by highlighting it.
PS: You have earned yourself some green ;) I mean rep points from me

It may not look as bad but this is a time to step back and take a better look on every step moving forward. This is a very testing time for the economic outcome in the next few months. A very sad episode to have come upon an Indian family my heartfelt condolence to them.

WASHINGTON: Multiple gunshots echoed in the upscale home of an Indian family in a quiet, gated, suburban Los Angeles community last weekend, echoing the troubled times in America.
When police turned up on Monday morning after calls from a concerned neighbor waiting for a carpool ride, they found the body of 45-year old Karthik Rajaram, an unemployed financial adviser, lying in one room with a handgun he had used to shoot himself dead.
With him lay his two youngest sons Arjuna (7) and Ganesha (12), both shot dead. In different rooms across the house they found the bodies of Karthik’s wife Subasri (39), his mother-in-law Indra Ramasesham (69), and his eldest son Krishna (19). They all appeared to have been shot to death by Karthik Rajaram.

Police also found two suicide notes – one for the cops and one for extended family and friends -- and a will. In them, Rajaram he spoke of his financial difficulties and took responsibility for killing his family members, police said.

Paid membership irrespective of the amount of payment will drive away the people. With all dues respect to IV, there are defintely other places where you can get good(if not better) information for free.
Strength of online communities is always the members...the higher the members the better.
Having said that, I kind of disagree with the punishing the wrong answers with a $5.00...most of the answers in these forums are people experiences and they are not legal professionals. People will not be able to share the experiences openly/freely. I think, it's the responsibility of the questioner to pick the right answer and donate for the value that he/she deems the question is worth.
My thoughts...anyways..
