I didn't find where in the PDF AILA is saying the definition is illegal!
They provide one example a court ruling where the EE definition was established in the case of an insurance agent. But such an issue has already been address by the EE memo by USCIS (Temporary/Occasional Off-Site Employment).

If they keep the ON HOLD status for more than 45 days... That event is again a potential lawsuit material.... Because they are changing a Long standing practice which requires lawmaking ( ref: Rajiv Khanna's quote)
Regd AILA lawsuit i believe they are deliberately delaying so that USCIS change the Bulletin to C on its own ( from the fear of lawsuit). On the other hand USCIS is not doing that because they knows this weakness of AILA and trying to keep things stretching so that when OCT arrives this whole move will get weakened .... As soon as new bulletin with some availability comes out peoples will start losing motivation ...

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. If you need more info on this let me know I have gone through this and waited for almost three years to file for my spouse I resheduled my FP notice in 2004 to get married by the time my wife came retrogression kicked in and waited till June 2007 to file for my wife. My PD june 2002 still waiting

The rest of the dhol dhamaka can be done later. I don't want to get married and then have to wait another 5 years to bring in my wifey. My PD is Dec 2003.

They can also make labors portable between employers ie the PD of the labor is portable irrespective of its state! But I hope they have that vision and wisdom.Also please make us apply 485 without the need to visa number.90% of our problems will disappear

I believe we have rights. If the million of illegals think that they have the right to stay, why can't we? Obviously, everyone has their own experiences in the US. Some of you might not have hit the "boiling point" yet and so you might not have felt the heat!!! There are people who carry the entire family here and they depend on the GC to make a difference in life. You are you and you are entitled to your own interpretation as to whether or not this is RIGHT or Privilege. I believe what LogicLife said is very true as Immigration is a movement in life. If you don't believe, you probably don't deserve it when someone said you don't. I've been here for 12 whole years, got married and bought a house. I have been paying colleage tuition, taxes and my duties as an entity in this society. I deserve a green card.

this bill is a great example. iv is the only organization that ahs pushed for it. a bunch of "non voters". our constant pushing has helped bring lawmakers to our side and even corporations taht never cared about thsi before now have it on their agenda.

Most of the people on Immigration Voice come here for legal advice regarding immigration, what if IV negotiates a good rate with 3-4 Immigration attorneys and recommends those attorneys to members? Attorneys would get business due to IV recommendation, IV will get referral fee ($100-$200) per referral and members will get discounted rates from good attorneys.

I am also in same boat. I have been keeping myself busy with studies, I was able to complete MBA and as well PMP. However, I would like to caution people on study front. Please give lots of thoughts on what do you want to study. One of the problem which I am facing after my MBA degree i.e. I am more frustrated being stuck in current position and doing something for which I am over qualified.
I would be interested in knowing about prospect for folks like us in Aus. I would appreciate if someone on this thread provide some clues on Aus.
I went to India couple of months back and there are lots of opportunities. But, I am not convinced if Indian market will be able to sustain this momentum over long period of time due to infrastructure problems and weak governments.
It is good thread and we should keep sharing our thoughts.

I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......

So,
who do I blame? US govt? Or these Desi companies who have exploited H1B system to the core, abusing the system and making our lives miserable each day. Well I am about to join an organization, which will report these Desi companies straight to Department of Commerce, there are a group of students from other Universities who are planning to be a part of the organization.

Ok, clearly you did not read what I wrote or you did not understand it. Here is what I wrote..
"Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.". Some one left me a red saying "not all consultants from sleazy bodyshopping companies are incapable." I agree and I never said that. If I came across that way then I apologize.
Everybody is trying to survive in this world ..diff people react differently to same situation..lying on resume/achievements is not illegal(reason y no body is prosecuted because of this fact..they are simply denied that benefit) however its unethical ..but iam not here to preach ethics.
