Yes this is not a typo. This is true. Aman has made more financial sacrifices and time sacrifices than anyone else. Not a single penny has been reimbursed to him for his trips to DC, food and stay in DC or car rental in DC. He even risked his job and went to DC on unpaid leave at critical times because lobbying was important for getting our work done. We in the core team know this and when we see the kind of contributions we get from members, we feel disappointed that our efforts are not valued. When we started the $20 contributions people felt $20 was too high and wanted $10 per month or less. Sometimes reading posts that say IV core is selfish also disappoints us. People do not know the effort that goes in getting anything done. I don't think AILA is fighting this memo on the grounds that it is illegal because of the fact that E-E relationship is illegally defined by USCIS, but they are fighting on the grounds that it is illegal because such directives should come in the form of laws!
Simply put, they are telling USCIS to follow the laws passed by the Congress without providing their own interpretation. This could very well apply to AC21!

After re-reading AILA's response, it appears to me that they actually don't have a strong case to say that the "EE relationship" definition is illegal. They are going with the argument that a precedence has been set for 50 years, and that is one of the main reasons why USCIS should continue to interpret the EE relationship that way. I'm not sure how strong a case this can be.
Re-read AILA memo once again. You haven't noticed the main point yet. Precedence is not their main point. Precedent just provides an additional support. E-E is the most controversial item in the USCIS memo which also is illegal.

By the way "pointless" is one of the those people who have been leaving comments like "chuteya" when giving red dots.
How do I know that ? a regular member may not be able to view this information but certainly moderators can.

To me; it looks like it could be a shift in change of policy. In the denial notice; it is the same officer number who sent the notice of intent to deny. Therefore; it is not a training issue; looks like something else is happening.

It is hard to believe that someone can suddenly change policy internally and not talk about it. In my case the officer id who issued denial is different from the officer id who issued NOID.

I believe after this new fees, we might have to pay one more time for the renewal and after that we never have to pay for any renewals. So it will not be a factor any more.

Lou Dobbs was in Orange County this weekend as a Keynote speaker at the The World Affairs Council of Orange County. He launched into his usual vitriolic diatribe, there were many business leaders at the forum and he ended up polarizing the crowd. Some felt that he is all talk with no practical real life experience managing companies, his ideas are over the top and cannot be implemented. He never ran or lead a fortune 500 company or held a major political office, yet he critiqued the very organizations who sponsored tables for this dinner. A few did get carried away by his speech, i have to say that the crowd at the back was cheering wildly for him while the executives in the front were subduded. BTW this person with socialist leanings has hefty appearance fees.
We would be better off not wasting our time on him or rebutting his indirect accusations, he is playing to his crowd. We should play to ours.

There is a weekly conf call with attorney Prashanthi on thursday 9 pm EST. In one of the calls I had this question and the answer is that once you use AC21, the most recent company were you are working and where your GC got approved will be your sponsor so u have to stay with that company for 6 months ( the time duration is debated in other threads)

So one should not report these contribution in their tax returns. I have also sent you a PM.

Given a choice and circumstances, I would have opted for U.S.C as "I have no hope for this world neither do I wish for it" - quoting Bhagawan Krishna from Bhagavad Gita.
This is a just prospective as you view it. The prospective also can change with time like so called material perfections in USA.

I don't understand the movement of PD at all.
The only way I can explain is that PD depends on approved LC before PD. Such persons can apply for GC because they are current.

Now that USCIS / DOS know that they have made mistake and also aware that this is exposed to the entire country. So this is what they are doing.
1. Keep all the applications pending so that AILF could not start the lawsuit. ALIF needs rejection proof.
2. Updated their site stating the receipt notice will be sent after Aug 1st, So everyone keeps quiet till this date.
3. I beleive, the Judge will rule out by July 29 saying that itis fault of DOS / USCIS and say they have to accept all the applications which are filed in July leaving the applicants only two days to file.
4. No one can argue that all the ELIGIBLE applicants should be allowed to file. The reason is NOT all the eligible applicants filed in June. Also if you feel that you are eligible for July, then you should have prepared all your application papers ready by July 29. If you cannot file, you are out.
I feel, this is what is going to happen. So better prepare your papers and keep it ready.
As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

Read again. I did not call the consultants sleazy. Also, I did not generalize them. My support is followed in the second line.
To me, this statement does not really deliver anything substantial or meaningful. Can you please reiterate?

This is not an argument about accounting principles. Even if I tie your statement to my points, it does not compute. I am against labeling and generalizing EB-3 and I said that in my post. Please read my post again.
