    i will go ahead and give my take on this based on my experience

    1) some doctors DO NOT give a waiver since they think its OK to take a TB test during pregnancy itself, let alone not taking after child birth. so call the doc b4 you go.
    2) I believe as long as the doctor gives you a blanket waiver it should be fine, thats all the proof you probably mifght need..

    I dont think USCIS is so crude to go into getting excruciating evidence in these type of situations...good luck;)

    I would call the USCIS if first off , they could give you more time..saying that she is traveling....if not get a blanker waiver..

    Our immigration doctor, as a std. practice, don't do TB test during pregnancy. That's the reason we didn't do TB test for her during July 2007 fiasco.

    Unfotunately what you are saying sounds cool except that its not true.
    Job offer has to be valid on the day petition filed or the specific date mentioned.

    There is nothing cool here. Employer did mistake by charging money and candidate came to US uninvited.

    Good job laying out all usecases "add78".

    In my case, I travelled back on AP as my visa extension stamping went pending in Mumbai consulate. Came back here with my I-94 indicating "Parolee" as my new status.
    Within 2 weeks, I changed employer as per AC21, they filed for my H1 transfer(premium processing) via Murthy Law Firm. I received a new I94 which put me back in the H1B status. During this 2-3 weeks I was in the US as a parolee I did NOT use the EAD, because you don't have to.
    Interestingly after 3 months of my visa application at Mumbai consulate (2 months after I reached US) I received an email from them asking me to submit my passport for stamping. Its unbelievable that they think applicants would still be waiting in India for 3 months and that their employers would still be interested in keeping them, but I guess after all this ordeal I realised, they just don't care.

    However, H-1B workers are legally required to pay the same taxes as any other US resident, including Social Security and Medicare. Some H-1B workers are not eligible to receive any Social Security or Medicare benefits unless they are able to adjust status to that of permanent resident. However, if their country of citizenship has a tax agreement with the United States, they are able to collect the Social Security they've earned even if they don't gain permanent residency.

    In some cases, H-1B workers pay higher taxes than a US citizen because they are not entitled to certain deductions (eg. head of household deduction amongst many others).

Debugging Indian Computer programmers", the author, an Indian software engineer, has slammed Lou Dobbs of CNN for calling the foreign high-tech workers as non-tax payers, and humiliating the enormous contributions of foreign high-tech workforce to the American economy.

    "Foreign high-tech workers who come here on H-1B / L1 visas pay every tax that U.S. citizens do, including Social Security and Medicare. But if they return to their homeland, then they will not get any benefits from these programs. The recent recession cost the United States more than half a million foreign high-tech workers who had to return home after paying all these taxes. In fact, Americans owe them money"

    The author writes.

    "The ignorance to mention the stupendous contributions of immigrant high-tech workers was the primary cause for the anti-Indian atmosphere which is seen among computer professionals lately. Unfortunately, neither the media nor the public understand the foreign high-tech workforce. The net result: those who supported the foreign high-tech worker programs have taken a back seat to play safe, and Indians and others who came here on visas, and worked their butts off to make this country prosper are named 'slaves', 'dummies', and 'enemies'. writes the author, N.Sivakumar.

    The book also claims that bringing in foreign high-tech workforce at the right time was the primary reason for America's stupendous high-tech success, and gives statistics and evidence to prove that hadn't America acted quickly, the Europeans would have taken over the software dominance.

    The book also outlines the life, struggle and achievements of Indian programmers in America with entertaining facts, and is a prime discussion topic in many anti-outsourcing and immigration websites lately.

    First of all...Welcome to Immigration Voice.

    Nitin, how do you think that people who are here in this forum does not know about the other options available? Where in this world you get as many opportunities as you get in USA? Where can you get the flexible life like here?

    How many IT jobs are there in Canada (assuming most of the members in IV are into IT)? Canada Alberta program increased processing times to 8 months now and it excludes federal processing times. Federal application method takes more than one and half years.

    So its good that you have chosen an alternative and worked out well, but your alternative many not be an alternative or not even option to all!!!

    The EAD doesn't get invalid when AOS is denied and will be valid till its expiration date.

    On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.

    Thoughts?

    Could you explain what you mean by this? Are you referring to "Flash Trading"
    or the whole of HFT?

    Yes Flash trading, ELP (enhanced liquidity program), direct access trading and even other program trading. The programs seek out discreet blocks that are being routed into the market and front run them. The main culprit according to many is GS. And to acheive a significant alpha the size and leverage are huge. Some program with a bug will dump a lot of shares on the market some day and before any one can react. Here is an article on some info that was made available only to bloomberg users.

    A recent Bloomberg piece that for some reason was made available only
    to terminal subscribers, provides a very interesting discussion on the
    dangers of sponsored access, how the associated pre-trade vs post-
    trade monitoring deliberations by "regulators" will influence short
    selling curbs, and not surprisingly, the desire by Goldman to not only
    dominate this yet another aspect of high-frequency trading, but to
    dictate market policy at will.
    What is sponsored access:

    In sponsored access, a broker-dealer lends its market participation
    identification (MPID) number to clients for them to trade on exchanges
    without going through the broker's trading system, to avoid slowing
    down the execution. That places responsibility on the broker-dealer to
    make sure the participant abides by securities regulations, and that
    its trading, which can involve hundreds or thousands of orders a
    second, does not run amok.

    Is it thus surprising, that none other than Goldman Sachs is muscling
    its way into providing not only a sponsored access platform to its
    clients, but a new form of sponsored access that needs the blessing of
    regulators:

    Wall Street heavyweight Goldman Sachs, now launching its own sponsored-
    access service to lend clients its identification to access securities
    exchanges directly, said last week it favors monitoring client orders
    prior to execution.


    "Our view is that there is a real need for pre-trade checks in the use
    of sponsored access to fulfill [broker-dealers'] regulatory
    responsibilities," said Greg Tusar, managing director at Goldman.


    Goldman's stand in favor of pre-trade instead of post-trade monitoring
    of sponsored clients' activity is one side of a debate in which
    regulators may choose a middle ground. The regulators' decision on how
    to monitor sponsored access may also influence their deliberations on
    restricting short sales.

    What is the difference between pre-trade and post-trade monitoring? In
    brief:

    Pre-trade

    Compliant with Reg SHO
    Nip problems before they happen
    View activity across exchanges

    Post-trade

    Faster order executions
    Pre-trade systems still fallible
    And another tidbit:

    In traditional sponsored-access arrangements, a broker-dealer
    determines a client's suitability to access market centers directly
    and then allows the client to trade without monitoring its individual
    orders prior to execution.

    In other words, the Goldman endorsed pre-trade approach will allow
    "monitoring of individual orders prior to execution." Whether or not
    pre-trade checks provide the capacity to observe not just wholesale
    exchange activity in the context of sponsored access but from a much
    broader market angle is a discussion for another time, although this
    could be one place where Sergey Aleynikov could shed an infinite
    amount of light, especially as pertains to Goldman's sponsored-access
    service. Conveniently, his gag order will prevent him from saying much
    if anything until such time as there is an appetizing settlement to
    keep him gagged in perpetuity. The bottom line is that with a pre-
    trade environment, the sponsored access providers will be able to have
    the potential to front run all those who use their platforms. The
    residual question of how far they go to comply with regulations to
    prevent this from happening, and remain true to their ethics standards
    is also a topic for another day.

    Going back to the topic at hand. Here is why sponsored access could
    easily be quite a bother to capital markets sooner rather than later:

    Unchecked errors or unintended repeat orders could deplete broker-
    dealers' capital, and potentially wreak havoc in the broader market.
    Concerns have arisen, however, about whether all broker-dealers are
    able to fulfill that duty in today's electronic trading environment,
    and according to which standards.

    And here Goldman chimes in to not only promote their proposed
    architecture but to expound on the virtues of pre-trade checking.

    "In the case of high-frequency trading, in particular guarding against
    technology failures, oversized orders and other situations where
    there's potentially systemic market impact, we believe strongly that
    pre-trade checks are a prerequisite," Tusar says.

    Nasdaq's proposal as well as Securities and Exchange Commission
    officials' speeches a few months ago appeared to lean toward
    bolstering the traditional approach.


    "We don't believe that's strong enough or what the regulators want
    now, because of the potentially dire consequences, and because we-as
    broker-dealers-bear much of that risk," Tusar says.


    Now the reason why this is very relevant in the context of not just
    potential front running, but also market structure is that Regulation
    SHO, which is the primary regulatory framework for short selling (and
    the purvey of potential Uptick Rule reinstatement, which will happen
    once the market is allowed to hit a bid) is a post-trade
    architecture.

    Wedbush [Morgan] routinely tests clients' systems to ensure they are
    compliant with Reg SHO. In addition, he says, the brokerage sets
    limits on clients available locates-as well as credit and trading
    limits--before the start of each trading day that its system tracks,
    prohibiting shorts without locates and providing a type of pre-trade
    check.

    Or as has recently become the case, seeing rolling buy ins in the
    middle of the day as borrowable shares in even the most liquid stocks
    mysteriously disappear (look at today's market action for yet another
    blatant example of this practice).

    Anticipating the regulators' likely response, one should not be
    surprised to see them siding with Goldman and against shorters:

    As the SEC also seeks to appease investor concerns over rampant short
    selling, especially naked short selling, new sponsored-access
    standards may provide part of the solution. Given that day-traders may
    be the last remaining culprits of such activity,, increasing and
    standardizing scrutiny over their trading may reduce uncovered (and
    illegal) shorts even further.

    How about appeasing concerns over rampant, unjustified buying? When
    will the downtick buy rule be implemented? But we jest.

    And I digress again. Why should all this be concerning to advocates of
    stability of high-frequency trading:

    The mother of all concerns is a sponsored firm's algorithm going awry
    and executing thousands of problematic trades across a range of
    securities and market centers.

    Well, this is not really a problem when it happens to the upside as
    has been the case for months now - it is only a threat when Joe
    Sixpack's 401(k) may be impacted, i.e., to the downside.

    And here is where a SEC Comment submitted by broker Lime Brokerage is
    a very troubling must read by all who naively claim that High-
    frequency trading is a boon to an efficient market (which doesn't
    provide . Well, yes and no - it is, until such moment that it causes
    the market to, literally, break. I will post a critical excerpt from
    the Lime submission, and leave the rest to our readers' independent
    analysis:

    Lime's familiarity with high speed trading allows us to benchmark some
    of the fastest computer traders on the planet, and we have seen CDT
    (Computerized Day Trading) order placement rates easily exceed 1,000
    orders per second. Should a CDT algorithm go awry, where a large
    amount of orders are placed erroneously or where the orders should not
    have passed order validation, the Sponsor will incur a substantial
    timelag in addressing the issue. From the moment the Sponsor�s
    representative detects the problem until the time the problematic
    orders can be addressed by the Sponsor, at least two mintues will have
    passed. The Sponsor�s only tools to control Sponsored Access flow are
    to log into the Trading Center�s website (if available), place a phone
    call to the Trading Center, or call the Sponsee to disable trading and
    cancel these erroneous orders � all sub-optimal processes which
    require human intervention. With a two minute delay to cancel these
    erroneous orders, 120,000 orders could have gone into the market and
    been executed, even though an order validation problem was detected
    previously. At 1,000 shares per order and an average price of $20 per
    share, $2.4 billion of improper trades could be executed in this short
    timeframe. The sheer volume of activity in a concentrated period of
    time is extremely disruptive to the process of maintaining a �fair and
    orderly� market. This shortcoming needs to be addressed if the
    practice of Naked Access is going to be permitted to continue;
    otherwise, the next �Long Term Capital� meltdown will happen in a five-
    minute time period.

    Moderators, do you think it's possible to issue an email receipt to contributors? I donated $250 so far and the first $100 was done through my bank billpay.. However, the online billpay deducted the amount right away, and it didn't give me any indication whether the check was actually endorsed by the intended recipient on the supposed delivery date.. Worrying about that, I sent in my second contribution via paypal.

    Writing an actual paper check, I would see a copy of endorsement online, or using paypal I would know it's cashed out via email. But this is not the case with my bank's (bank of america) online billpay. Thanks!

    normally iPod skins don't change the appearence of your surroundings....

    Yes, and normally, iPods aren't always on white backgrounds. Last time I checked, my jean pockets were blue :)

    I should also add, that the backgrounds are chosen based on what best suits the iPod. Normally Apple displays their iPods on white backgrounds because that's what they look best on, but when they came out with the U2 iPod(which BTW has a modded clickwheel) they have pictures of it on a black background(http://images.apple.com/ipod/u2/gallery/images/u2front20041026.jpg) because that's what it looks best with.

    You can't expect people to make tons of unique skins and then not make backgrounds that show them in their best light. A white background wouldn't go with my skin design nearly as well.

    I am in eb3 row, have a job waiting for me in the usa, but i am in england,
    Have a PD of june 06, am terrified that my job offer will be withdrawn if i dont make some progress soon. Have had job offer for 1 year this week.
    My soliciter has written to nvc to try and shed some light. but im not expecting much joy.

    But from the posts, i have read in this thread, do i detect a glimmer of hope for my situation.?

    Could EB3 row become current soon.??

    It is just so unjust that i have to wait the length of time that i have, its not so bad if you are already out there, and just changing your status, but for some one in my position trying to perminently relocate, job waiting for them, no family, just me, clean as a whisle and not able to do anything because you are stuck in the same que as everyone else is just a nightmare. I have had my life on hold for a little under 2 years for this. And im only 24.

    Im starting to wonder just how much longer i can wait. Life has to go on you know. Im loosing some of the best years of my life to stand in a fucking que, for something that may never happen. It is almost enough to make you think about becoming and illegal.

    Yes it applies for IV too. We have a handful of monthly subscribers because everyone wants the other person to pay for it. If the problem needs to be solved, each victim needs to fight this problem.

    Do let us know the outcome of your complaint.
    Please also inform others how you went about making this complaint.

    Filing the complaint is the easiest thing that I have done in a long time. As I had lots of written evidence so it took me close to 30 minutes to prepare the everything but normally it should take no more than 10 minutes. The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.

    When I filed a complaint, I sent the whole package via FedEx. I waited for few weeks to hear from DOL but when nothing happened I went to their office (they are few blocks away from me). I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. The investigator asked me to resubmit the package which I did the next day. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.

    Actually, not all he said was wrong.
    We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.

    My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.

    Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..

    I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"

    I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.

    Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..

    Well, I do agree with you.

    H1B program itself is good, but when people try to exploit/misuse the program and find ways that are not morally and legally correct, to get more H1B's then it needs to be punished. In my view, targeting these folks and barring them from sponsorship of H1B's is necessary, and requires meaningful changes to the system, not just increase in fees for H1B sponsorship.
