    So far from the poll results I see that most of us are here by choice ( though we are put thru GC waits). no matter what we will try to stay here until we reach our personal breaking point which would tigger us to look at alternatives.
    Someone here asked what independence and freedom has to do with the Quit America thing. Most of the immigrant community feels that they are not given access to lot of things due to restrictions in their visas and unpredictable GC process. And the inconvenience and trouble their familes go through. With that in prespective I am thinking that we have lost atleast some of our freedom and independence.
    This reason for this poll is to also make people think .

    Hi Guys. I am trying to take an appointment in Jan. The earliest I can get is 11th in Kollkata. I have booking to travel to US on 26th. After listening to the delays here, I am confused where to go for stamping or return with AP.:confused::confused:

    Please advise; guys who have been through stamping recently. Appreciate your feedback.

    About couple of weeks ago my employer had arranged a, life after AOS with our attorney and in their presentation they clearly mentioned that if you have AP don't go for visa stamping waste cople of days of your life.

    Correct me if my attorney is wrong and if there is any advantage in getting the visa stamped.

    I dont think companies are really geared to file for 140 within 45 days of labor approval...
    The condition is not for "to file 140 within 45 days of labor approval"
    But it is for the company to substitute the LC for some other employee.

    There is no time limit set to file I-140 for the employee for whom the LC was issued.

    AILA opposes this 45 days condition on the premise that they can not find and recruit a person to apply LC substitution within 45 days.

    Anyway it is good to see majority of the "LC-jumpers" will be stopped.

    We already have chapters as the first and foremost source of valuable information. Once someone becomes involved and committed, they will signup for monthly contributions themselves. If we have enough of that to guarantee a decent source of recurring income like 20 40 k or whatevr, I dont see the need to deprive some depressed soul surfing the net looking for some reassuring information from having to goto bed in peace.

    Suggestions to everyone wanting to file I485 when their date is not current:

    - Talk to the leaders of this campaign. Do not just sit back after voting. Ask what help they need and what work you can do as a volunteer. People affected need to take lead and work hard for any fix. This will not cost you any money. All you need to give is your time.
    - Consider signing up for recurring contributions every month. It takes lot of resources to run an advocacy effort and your support is critical.

    Yes, that is right, I said “plight of EB2-India”.

    I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

    Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

    Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

    There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

    All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

    For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

    most ridiculous argument and surprising because it is coming from a Phd. Surely, you must have defended your doctoral thesis, or did'nt you have one ? :p

    The people who go for Phds should know that they are sacrificing short-term future cash flows in exchange for a far superior long-term cash flows. The others "EB3" go for a more milder but increasing series of future cash flows.

    To each his own!!! But when people say that "my career is over because my gc is delayed" UNDERSTAND that they are venting their frustration. It does not mean that their career is really over.

    And, like you, they will also work here as long as they like it and if not, go back...

    Thanks everyone for the feedback. Can some guru put this issue to rest? I guess the only question that remains is:

    "For a person who has extended his H1 beyond the 6 year category on the basis of AOS, would this H1 extension be valid if I-485 is denied (either wrongly due to AC21 or otherwise)"

    I am working for a fortune 100 company for last 12 years, rose to a senior level position.     I went for the visa stamping in chennai consulate on Dec 5th. After a few questions, the officer granted me the visa and said i will receive the passport in a few days. But so far haven't yet received my passport. Does anyone know what is happening? is anyone faced such situation before? I heard about this admin processing and delays in stamping but i thot the officer would usually give out some kind of form to you during the interview if your case goes thru such processing.

    The web-site says we can send an e-mail to the consulate regarding any questions for NIV if it's pending more than 5 days. Has anybody done that and what would be the response?

    Please respond. i am running short of time as i have to travel back to US soon.

    often i'm amazed by the knowledge of some of the posters here...... but more often i get a laugh out of stupid ideas that r thrown around...... for example u want something big.... want to send transcript..... blacking out the name...... if there is no name on the transcript..... how will anyone know if its genuine...... so u r still afraid of someone knowing u'r name... but u want to do something big....... that makes real sense...... if u know what i mean..... then u want someone else to do a rally....... r u going to come to the rally?..... how will u hide u'r personal information when u come for the rally....... maybe time to take out the Halloween nixon mask.... to protect the personal information/identity..... and for the hunger strike.... lets have someone with a nixon mask do hunger strike...... we could just say that its not me who is doing the hunger strike.... its president nixon doing hunger strike on my behalf....... great idea...... by far the best one ;)

    You humor was not at all appealing neither it galvanized anyone. In stead of posting remarks, how about giving some constructive ideas? Or is too much to ask?

    We absolutely must make all forums accseible to registered members only and,
    - Non paying members will see a pop-up screen reminding them that they must contribute.

    I hope my previous post is not taken in any negative sense. I was only expressing my opinion. I believe in what IV is trying to accomplish and I have contributed to the cause. I was only implying my reservations to the fact that SKIL bill will be on some sort of fast track just because we are all waiting for 5 years. I was only saying requesting a small measure will go a long way to help us all, instead of looking for a big pay day from Skill Bill.
    There is a talk of border security bill that could be vehicle for our cause, provided we ask for reasonable measures.

    Date and Time of Delivery matters.


    All july 2ND FILERS... DOES THE DATE OF FILING(mailing date) MATTERS OR THE DATE OF DELIVERY MATTERS?
    I think most cases delivered on July 2nd is filed on June 29th or 30th.


    If USCIS decides to use the postmarked date as the filing date then it would be trickier for those whose PD was not current in June but have "filed" on June 29/30.
